Welcome to Defapi's AI API gateway service ("Service"). By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Our service operates as an AI API gateway and relies on third-party AI model providers (such as OpenAI, Anthropic, Google, etc.). You understand and agree that:

• We do not guarantee the availability, performance, or uptime of third-party services.
• Third-party services may change, interrupt, or terminate at any time, and such changes are beyond our control.
• The quality, accuracy, or suitability of content generated by third-party AI models is the responsibility of the third-party providers, and we assume no liability for this.
• Third-party service outages or failures may cause temporary unavailability of our service, for which we assume no responsibility.

We assume no liability for any losses or damages resulting from actions or failures of third-party service providers.

Purchases and Credits

We may offer goods or digital assets (such as credits) for purchase through our service. Purchased credits never expire. You agree to provide accurate payment information and to comply with any additional terms provided at the point of sale.

Intellectual Property

The Service and its original content (excluding user content) are owned or licensed by the Service operator. You may not copy, modify, distribute, or create derivative works based on the Service or content unless expressly permitted.

Trademarks, logos, and brand features appearing on the Service belong to their respective owners and do not imply any endorsement.

In the event of force majeure, we will make reasonable efforts to minimize the impact on services and restore services as soon as reasonably practicable.

Severability

If any part of these terms is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining portions shall remain in full force and effect. The invalid or unenforceable portion shall be replaced with the closest valid and enforceable provision that matches its original intent.

Entire Agreement

These terms constitute the entire agreement between you and us regarding the use of our service and supersede all prior or contemporaneous oral or written agreements, understandings, communications, or proposals.

Waiver

Our failure or delay to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy, nor does it affect our ability to exercise that right or remedy in the future. Any waiver must be explicitly stated in writing to be effective.
